Mr. Gainor is a seasoned and respected trial attorney, having been lead counsel in over 120 federal and state criminal jury trials during his forty-year career. He has an active federal and state trial and appellate practice. Mr. Gainor also represents applicants seeking pardons and clemency of sentences before the President of the United States in federal cases.
Mr. Gainor is licensed to practice law in the State of Florida and the State of Colorado and is admitted to practice law before the Supreme Court of the United States as well as multiple Federal District and Circuit Courts of Appeal.
From 1986 to 1989, Mr. Gainor served as a prosecutor in Miami, Florida under Janet Reno, the former Dade County State Attorney and Attorney General of the United States. In 2001 and continuing to the present day, Mr. Gainor is a founding partner in the firm of Gainor & Donner which focuses on the representation of individuals and corporations accused of complex economic crimes, national security violations, corruption / bribery allegations, drug trafficking, weapon and RICO crimes, civil and administrative violations, mutual treaty matters, forfeiture and appellate matters in all federal and state courts.
During his career, Mr. Gainor has led trial teams against the Department of Justice in Florida, Colorado, New York, California, New Mexico, Georgia and Oklahoma. He has represented executives of large health care entities and advised transportation companies in significant pre-indictment matters. Mr. Gainor is responsible for a landmark victory in the Northern District of California involving an executive of a national brokerage company charged with conspiracy to commit moving fraud and extortion. After a successful result in another case, the government re-drafted its investigative protocols involving the Department of Homeland Security (DHS) regarding internet investigations. Mr. Gainor regularly litigates against the Department of Transportation (DOT), the Federal Bureau of Investigation (FBI), the Drug Enforcement Agency (DEA), the Securities and Exchange Commission (SEC), the Secret Service (SS) and the United States Customs Service (USCS).
